Yet to be confirmed reports are coming in that Motorola Mobility may have just won a patent case in Germany that will allow them to ban sales of Apple’s mobile products in Germany. By now I’m sure most people are sick of hearing about these patent wars, I for one certainly am.
It is only the consumer that will loose out here whatever way things go as their choice of device will be stifled, but this particular case may be of some importance.
The root of this story comes from the Foss Patents blog which “COVERS SOFTWARE PATENT NEWS AND ISSUES WITH A PARTICULAR FOCUS ON WIRELESS, MOBILE DEVICES (SMARTPHONES, TABLET COMPUTERS)”.
Florian Mueller who runs the blog believes he has been passed a copy of a judgement from a court in Mannheim, Germany which rules that Apple are infringing on two of Motorola’s patents. While he hasn’t yet confirmed the authenticity of the ruling, he seems to be pretty satisfied that they are true.
If this in fact turns out to be the case Motorola will be able to stop the sale of Apple’s mobile products in Germany. While we have seen Apple win similar cases against Android Manufacturers, this would be a turning point in the patent war as Google now own Motorola and have stated that they will use their recently acquired patents to protect all of the Android Manufactures from these types of cases. They have shown this lately when they “gave” HTC several of their patents to use in a counter suit against Apple.
